(2)     No application for validation shall be considered by the Director if the applicant has -

(a)   been refused a South African pilot licence or validation before; or
          (b)   had a South African pilot licence or validation revoked in the past,

for reasons other than failing a skill test, a proficiency test, or a theoretical knowledge
         test.

(3)     Where, in the opinion of the Director or the designated organisation, the requirements for
the issue of a pilot licence by a particular Contracting State are lower than those set by the
 Republic, the Director or the designated organisation may direct that the applicant meets the
 higher requirements
