                                               NOTICE OF EXPROPRIATION
                                             OF VACANT LAND DESCRIBED AS
                 THE REMAINDER OF PORTION 736 OF FARM LOT 56, NO 931 REGISTRATION FU, PROVINCE OF
                     KWAZULU-NATAL - (PROPOSED PORTION 905 (OF 736) OF THE FARM LOT 56 NO 931)

FOR THE PURPOSE OF CONSTRUCTING THE BALLITO PUBLIC FACILITY ON (PROPOSED PORTION 905
                                           (OF 736) OF THE FARM LOT 56 NO 931)

Issued by the KwaDukuza Municipality ( "the Municipality ") in terms of the Expropriation Act, No. 63 of 1975, as
             amended, ( "the Expropriation Act "), read with the Local Authorities Ordinance, No, 25 of 1974 ( "the Ordinance ").

TO:    the owner (as defined in section  1 of the Expropriation Act) of the vacant land described as The
                    Remainder of Portion 736 Of Farm Lot 56, No 931 Registration FU, Province Of Kwazulu-Natal where
                    proposed portion 905 (of 736) of the farm lot 56 no 931 is to be used for the purpose of constructing the
                    Ballito public facility and which expression includes, but is not limited to the Trusteee or Liquidator in the
                    insolvent estate of the owner, and includes a representative of the owner in the Republic of South Africa;

AND TO       All other persons claiming any right to or an interest in the property described as The Remainder
                          of Portion 736 Of Farm Lot 56, No 931 Registration FU, Province Of Kwazulu-Natal where
                          proposed portion 905 (of 736) of the farm lot 56 no 931 is to be used for the purpose of
                          constructing the Ballito public facility whether by virtue of registration or otherwise, and
                          particularly any lessee, buyer or builder contemplated in terms of section 9(1)(d) of the
                           Expropriation Act.

1.     PLEASE, TAKE NOTICE THAT the Municipality in terms of the powers vested in it by section 156(1)(b) of
                    the Constitution of the Republic of South African, 1996 ( "the Constitution "), read with sections 1, 5 to 15
                    and 18 to 23 of the Expropriation Act, as well as section 190 of the Ordinance, hereby expropriates the
                    following immovable property for the public purpose of constructing thereon the Ballito Public Transport
                    Facility, namely, a taxi rank:

Vacant land described as The Remainder of Portion 736 Of Farm Lot 56, No 931 Registration Fu,
                        Province Of Kwazulu-Natal situated in KwaDukuza Municipality and measuring approximately
                        5 103m2 in extent (where the 5103m2 of land is designated as Proposed Portion 905 (of 736) of the
                        Farm Lot 56 No 931), which is owned by Shell South Africa (Pty) Limited (hereinafter referred to as
                        "the immovable property ").

2.     The date of expropriation of the immovable property shall be 29 December 2016, from which date
                    ownership of the immovable property shall pass to the Municipality, and any rights attaching thereto shall
                    vest in the Municipality.

3.     The date on which the Municipality shall take possession of the immovable property shall be 3 January
                    2017, or such other date as may be agreed upon between the owner of the immovable property and the
                    Municipality in terms of section 8(3) of the Expropriation Act, or a date determined in terms of the
                    provisions of section 8(5) of the Expropriation Act, as the case may be.
