             OCCUPATIONAL HEALTH AND SAFETY ACT, ACT 85 OF 1993 AS AMENDED
             INCORPORATION OF THE NATIONAL CODE OF PRACTICE FOR THE TRAINING PROVIDERS OF
             LIFTING MACHINE OPERATORS INTO
             DRIVEN MACHINERY REGULATIONS 2015

I Millysind E. Ruiters, appointed as Chief Inspector in terms of section 27(1) of the Occupational Health
             and Safety  Act,  (Act No.  85 of 1993),  as amended,  by virtue of the power  delegated  to  me  by the
             Minister of Employment and Labour in terms of section 42(1) of the Act, and after consultation with the
             Advisory Council for Occupational Health and Safety hereby-

1.  Withdraw National Code of Practice for Training Providers of Lifting Machine Operators published
                    on the Government Notice  R539  of Government  Gazette No.  38904,  and  mentioned on the
                    schedule published Government Notice R542 of Government Gazette No.38905,
                2.  Under Section 44 of the Occupational Health and Safety Act (Act No.85 of 1993), as amended,
                    incorporate into the Driven Machinery Regulations, 2015, the National Code of Practice for the
                    Training Providers of Lifting Machine Operators, 2024.
                3.  Exempt Training Providers in terms of Section 40 of the Occupational Health and Safety Act, (Act
                    85 of 1993), as amended   as required by regulation 18 (11) of the Driven Machinery Regulations
                    on  a  condition that they are  accredited by Quality Council for  Trade  Occupations  (QCTO)  or
                    Transport Seta (TETA)  until end  of  June  2027. With  effect  from end of June  2027 all training
                    providers shall be accredited by QCTO.
