104 No. 44061 GOVERNMENT GAZETTE, 8 JANUARY 2021 Case No: 67360/2019 IN THE HIGH COURT OF SOUTH AFRICA (Gauteng Division, Pretoria) In the matter between INVESTEC SPECIALIST BANK, PLAINTIFF AND LODEWIKUS JACOBUS LE ROUX VENTER, IDENTITY NO. 770119 5142 08 4, DEFENDANT NOTICE OF SALE IN EXECUTION: IMMOVABLE PROPERTY 26 January 2021, 10:00, Office of Sheriff, 1281 Church Street, Hatfield, Pretoria In execution of a judgment of the High Court of South Africa, Pretoria in this suit, a sale to the highest bidder, subject to such reserve price, if any, as may be stipulated by a preferent creditor or local authority in terms of Court Rule 46(5)(a) will be held at the office of Sheriff Pretoria South East at 1281 Church Street, Hatfield on Tuesday the 26th day of January 2021 at 10h00 in the forenoon, of the undermentioned property of the Defendants on Conditions to be read out by the Auctioneer at the time of the sale and which may be inspected at the office of the Sheriff Pretoria South East situated at 1281 Church Street, Hatfield prior to the sale. A unit consisting of- a) Section Number 1 as shown and more fully described on Sectional Plan Number SS 640/1993 in the scheme known as ERAS583 in respect of the land and building or buildings situated at ERF 583 ERASMUSKLOOF EXTENSION 4 TOWNSHIP, Local Authority: CITY OF TSHWANE METROPOLITAN MUNICIPALITY, of which section the floor area according to the said sectional plan is 137 (one hundred and thirty seven) square meters in extent; and b) an undivided share in and to the common property in the scheme apportioned to the said section in accordance with the participation quota as endorsed on the said sectional plan. Held by Deed of Transfer ST42017/2018 SUBJECT to such conditions as set out in the aforesaid Title Deed SITUATED AT: 391 UMGENI ROAD, ERASMUSKLOOF, PRETORIA THE PROPERTY IS ZONED: RESIDENTIAL The following information is furnished regarding improvements on the property although nothing in this respect is guaranteed: HOUSE CONSISTS OF 3 BEDROOMS, 2 GARAGES AND 1 DINING ROOM. The Purchaser shall in addition to the Sheriff’s commission, which is 6% on the first R100,000.00, 3.5% on R100,001.00 to R400,000.00 and 1.5% on the balance of the proceeds of the sale up to a maximum fee of R40,000.00 in total plus VAT and a minimum of R3,000.00 plus VAT, pay a deposit of 10% of the purchase price in cash or bank guarantee cheque on EFT into the sheriff’s trust account immediately upon closing of the bid and the balance against transfer which shall be secured by a Bank or Building Society guarantee in a form acceptable to Plaintiff’s conveyancers, which guarantee shall be delivered by the purchaser to the sheriff within 21 (twenty-one) days from the date of the sale and shall provide for the payment of the full balance and any such interest payable as provided for hereunder. Should the purchaser elect to pay the balance of the purchase price, this must be paid into the sheriff’s trust account within 21 days (court days), from date of sale as per the Conditions of Sale in which case any claim for interest shall lapse. Take further note that: 1. This sale is a sale in execution pursuant to a judgment obtained in the above court. 2. The Rules of this auction and a full advertisement is available 24 hours before the auction at the office of the Sheriff Pretoria South East, 1281 Church Street, Hatfield. 3. The Sheriff Pretoria South East will conduct the sale. Registration as a buyer is a pre-requisite subject to conditions, inter alia:- A) Directive of the Consumer Protection Act 68 of 2008.
