4. Amendment of Section 6 of Act No. 3 of 1994

Section 6 of the Principal Act is hereby  amended by the substitution for   section 6
                     of the following section:

( " 1 An
                        ) V erson summoned to attend and who without sufficient
                                                                                          cause the onus
                                                                                                 (
                     of roof whereof shall rest   p u on him or her -
                        p
                                                                  )
                        (a) fails to attend at the time and lace  p s ecified in the summons'  or
                                                           p
                        (b) fails to remain in attendance until  the conclusion of the en ui rY or until he or
                                                                                        q
                            she is excused b    Y the chai erson of the commission           from further
                                                             rp
                            attendance or

(c) refuses to be sworn  or to make affirmation as a witness after he   or she has
                            been re uired b the chair  p erson of the commission to do so

                           shall be  q uil tY of an offence.

(2) An VPerson who has been sworn in or has made        an affirmation as a witness

and who without sufficient   cause the onus of     roof whereof shall rest    p u on

him or her -
                            (a) fails to answer full and satisfactoril Y an VQuestion lawfuil V ut to him or
                                                   V
                                her or

(b) fails to roduce an book document       or ob ect in his or her ossession

or custod    or under his or her control which he        or she has been
                               summoned to roduce
