NATIONAL ENVIRONMENTAL MANAGEMENT: BIODIVERSITY ACT (10/2004)
                    NOTICE OF INTENTION TO DECLARE ERF 5159, ERF 3023 AND ERF 3009 BETTYS BAY AS AN
                             EXTENSION TO THE HAROLD PORTER NATIONAL BOTANICAL GARDEN

I, Barbara Dallas Creecy, Minister of Forestry, Fisheries and the Environment hereby, in terms of Section
                   33(2)(b) of the National Environmental Management: Biodiversity Act, 2004 (Act No. 10 of 2004), give
                   notice of the intention to declare Erf 5159, Erf 3023 and Erf 3009 Bettys Bay as an extension to the Harold
                   Porter National Botanical Garden.
                   The Harold Porter National Botanical Garden is one of the national botanical gardens managed by the
                   South African National Biodiversity Institute (SANBI) and forms part of the Kogelberg Biosphere Reserve,
                   a UNESCO World Heritage Site. The garden covers an area of 200.5 hectares and showcases the rich
                   diversity of the Cape Floral Kingdom.

Erf 5159, Erf 3023 and Erf 3009 Bettys Bay are three adjacent pieces of land located near the garden,
                   measuring approximately 11.3 hectares in total. Erfs 3023 and 3009 are state-owned and are being
                   managed by SANBI with the intention of incorporating them into the garden. The lands contain natural
                   vegetation that is representative of the coastal fynbos region, as well as some alien invasive plants that
                   need to be cleared. The lands also serve as a natural buffer zone between the garden and the
                   surrounding urban development.

The declaration of these land portions as an extension to the garden will enhance its conservation value,
                   protect its biodiversity, provide opportunities for restoration, research, education and recreation, and
                   contribute to the objectives of the Act and other relevant policies and legislation.
                   Members of the public are invited to submit written representations on or objections to this notice within
                   60 days from the date of publication of this notice in the Gazette.
