PROVINCIAL NOTICE 142 OF 2021

REMOVAL OF RESTRICTIVE TITLE DEED CONDITIONS AND BUILDING LINE
                 DEPARTURE FOR ERF 9738, EAST LONDON: 25 LATIMER ROAD, BEREA

1.  In terms of section 47(1) of the Spatial Planning and Land Use Management
                        Act  No  16  of  2013,  read  with  section  59  of  the  Buffalo  City  Metropolitan
                        Municipal Spatial Planning and Land Use Management Bylaw of 2016, approval
                        is hereby granted for the removal of restrictive title conditions B .(a), (b), (c), (d)
                        from Deed of Transfer T6052/2002 pertaining to Erf 9738, East London in terms
                        of Section 59 read with chapter 6 of the Buffalo City Spatial Planning and Land
                        Use Management by Law.

2.  Approval is also hereby granted for a Permanent Departure in term of Section
                        15 of the Land Use Planning ordinance 15 of 1985 as well as in terms of Section
                        64 of the By-Law pertaining the Spatial Planning and Land Use Management
                        Act (Act 16 of 2013), in order to permit the relaxation of the lateral building line
                        restriction from 2m to 0.5m, adjacent to Erf 9737, East London.

                   Removal of Restrictions in terms of the Spatial Planning and Land Use
                   Management Act, 2013 (Act 16 of 2013).
                   Erf 428, Sunridge Park, Port Elizabeth, Eastern Cape.
                   Under section 47 of the Spatial Planning and Land use Management Act, 2013
                   (Act 16 of 2013) and upon instructions by the Local Authority, a notice is hereby
                   given that conditions 5.(b), (d) and D.(iii), (iv) contained in Deed of Transfer No.
                   T7591/2018 applicable for Erf 428, Sunridge Park, are hereby removed.
