PROCLAMATION 15 OF 2018
          
                                                   CONDITIONS OF ESTABLISHMENT
                      STATEMENT OF CONDITIONS UNDER WHICH THE APPLICATION MADE BY BELA BELA LOCAL MUNICIPALITY
                      (HEREINAFTER REFERRED TO AS "THE APPLICANT ") IN TERMS OF THE PROVISIONS OF CHAPTER IV OF THE
                      TOWN-PLANNING AND TOWNSHIP ORDINANCE 15 OF 1986, FOR PERMISSION TO ESTABLISH A TOWNSHIP ON
                      PROPERTY KNOWN AS:
                            PORTION 4 OF THE FARM BELABELA NO 647, REGISTRATION DIVISION K.R, and LIMPOPO PROVINCE,
                            HAS BEEN GRANTED
                      1.    CONDITIONS TO BE COMPLIED WITH PRIOR TO THE DECLARATIION OF THE TOWNSHIP IN TERMS OF THE
                            PROVISIONS OF SECTION 110 OF THE TOWNSHIP PLANNING AND TOWNSHIPS ORDINANCE, 1986
                            (ORDINANCE 15 OF 1986).
                            1.1    MINERAL RIGHTS
                                   The Township Applicant shall procure the consent of the State, being the holder of the rights to minerals in
                                   respect of the land on which the township will be developed.
                                   GENERAL
                                   The Township Applicant shall immediately after approval of the township take the necessary steps to
                                   prepare the Amendment Scheme in accordance with the requirements of the BELABELA Land Use
                                   Scheme. 2008, as amended, and shall simultaneously with proclamation of the township as an approved
                                   township, take the necessary steps to have the Town Planning Scheme amended by including the
                                   township therein.
                                (b)  The Township Applicant shall comply with the provisions of Section 110 of the Town Planning and
                                   Townships Ordinance, 1986.
                      2.    CONDITIONS OF ESTABLISHMENT
                            2.1    NAME
                                   The name of the Township shall be BELABELA EXTENSION 8
                            2.2    TOWNSHIP LAYOUT /DESIGN
                                   The township shall consist of erven and streets as indicated on the General Platt No. 10557/2006

2.3    PROVISION OF ENGINEERING SERVICES
                                   All engineering services provisions to the township shall take place in terms of the provisions of Chapter V
                                   of the Town-planning and Townships Ordinance, 1986 (Ordinance 15 of 1986 ) and also according to the
                                   municipal council decision.
                            2.4    DISPOSAL OF EXISTING CONDITIONS OF TITLE
                                   All ervens shall be made subject to existing conditions and servitudes if any,including the reservation of
                                   rights to minerals and real rights, but excluding the following conditions which are not to be transferred to
                                   the individual ervens in the township due to their location:
                                   2.4.1  An order of the Supreme Court of the Transvaal dated the 14`" November 1905 confirming
                                         certain Arbitrator's Award dated the 2nd of June 1905, a certified copy of which Arbitrator's Award
                                         and General Plan therein referred to marked Ž "and "B" respectively are annexed to Deeds of
                                         Transfer Nos, T8961/1916 and T 8962/1916
                                   2.4.2  Die voormalige Gedeeite 82 van die gemelde pleas Buiskop 464-KR, aangetoon op die
                                         aangehegte kaart deur die figuur xx b'b' alai yy xx is onderwerpe
                                         Kragtens Notariele Akte K1876/1974-S gedateer 23 April 1974 is die hierinvermelde eiendcm
                                         onderworpe aan beperkings met betrekking tot die oprigting van geboue en hoogte van borne
                                         ten gunste van Eskom sons meer volledig sal blyk uit gemelde notariele akte die gebied waarvan
                                         op die aangehegte kaart aangetoon word deur die figuur b" e11 a' a' yy
                                   2.4.3  Die voormalige Gedeelte 83 van die gemelde pleas Buiskop 464-KR, aangetoon op die
                                         aangehegte kaart deur die figuur b1 b1 c' c' E a' a' b' b' is onderwerpe aan:
                                         Kragtens Notariele Akte K2101/1975-S soos gewysig Notariele Akte K1823/1979-S is die
                                         eiendom onderhewig aan beperkings met betrekking tot oprigting van geboue en die hoogte van
                                         borne met bykomende regte ten gunste van Eskom soos meer volledig sal blyk uit gesegde
                                         notariele akte welke serwituut gebied op die aangehegte kaart aangetoon word deur die figuur f"
                                         g" E a' a' f''.
                                   2.4.4.  Servitude Kragtens Notariele Akte K1014/1973-S soos gewysig deur Notariele Akte K1573/79-S
                                         is die reg aan Eskom verleen om elektrisiteit oor die eiendom to vervoer tesame met bykomde
