PROVINCIAL NOTICE 41 OF 2021

KWAZULU-NATAL DEPARTMENT OF ECONOMIC DEVELOPMENT, TOURISM AND
                      ENVIRONMENTAL AFFAIRS

DECLARATION OF THE ELANDSBERG PROTECTED ENVIRONMENT IN TERMS OF SECTION
                       28(1) OF THE NATIONAL ENVIRONMENTAL MANAGEMENT: PROTECTED AREAS ACT, 2003

I, Ravigasen Ranganathan Pillay, in my capacity as Member of the KwaZulu-Natal Executive Council
                      for Economic Development, Tourism and Environmental Affairs, and under powers vested in me by
                      section 28(1) of the National Environmental Management: Protected Areas Act, 2003 (Act No. 57 of
                      2003) ("the Act"), hereby declare that -
                           (a) ) subsequent to consultation with the relevant parties as contemplated in section 32(2) of
                           the Act;
                           (b)  subsequent  to  the  publication  of  Notice  Number  147  of  17  December  2021  in  Provincial
                           Gazette 2247, and an advert in two national newspapers, in which my intention to declare the
                           Elandsberg Protected Environment was duly published in accordance with the requirements of
                           section 33(1) of the Act; and
                           (c) with effect from the date of publication of this Notice,
                      the  properties  described  in  the  Schedule  hereto  are  a  Protected  Environment  known  as  the
                      Elandsberg Protected Environment, as respectively contemplated in sections 28(1)(a)(i) and 28(1)(b)
                      of the Act.

The protected area comprises the following immovable properties:
                        1.  Portion 4 of the Farm Uitkomst No. 38, Registration Division HT, Province of KwaZulu-Natal,
                           measuring 761,6970ha in extent, held by Deed of Transfer No. T28863/1989.
                        2.  Portion 6 of the Farm Uitkomst No. 38, Registration Division HT, Province of KwaZulu-Natal,
                           measuring 158,4582ha in extent, held by Deed of Transfer No. T1104/1982.
                        3.  Remaining extent of portion 1 of the Farm Deelspruit No. 36, Registration Division HT, Province
                           of  KwaZulu-Natal,  measuring  531.1405ha  in  extent,  held  by  Deed  of  Transfer  No.
                           T37503/2003.
                        4.  Portion 2 of the Farm Deelspruit No. 36, Registration Division HT, Province of KwaZulu-Natal,
                           measuring 920,6142ha in extent, held by Deed of Transfer No. T37503/2003.
                        5.  Portion 3 of the Farm Deelspruit No. 36, Registration Division HT, Province of KwaZulu-Natal,
                           measuring 158,9171ha in extent, held by Deed of Transfer No. T37503/2003.
                        6.  Portion  1  of  the  Farm  Protest  No.  117,  Registration Division  HT,  Province  of  KwaZulu-Natal,
                           measuring 470,1304ha in extent, held by Deed of Transfer No. T986/1980.
